Gold Miner Dave Carson is afraid of the crooked law enforcement in town run by Mayor Gilbert Byron.  Dave is convinced that Gilbert is cooking up a scheme to steal his mine out from under him.  To aid him in protecting the mine, Dave contacts his friends Stoney, Tucson and Lullaby, known as the Three Mesquiteers, and offers them shares in the mine if they will help register the claim and protect it.  Right out of the chute, the mesquiteers catch one of Gilbert’s henchmen trying to steal Dave’s horse.  The local Judge, Henry Hixon, is firmly in Gilbert’s pocket and acquits the man.  The Mesquiteers and Dave begin rounding up signatures on a petition from the townspeople to appeal to the territory governor to run the crooked mayor and his cronies out of town.  Gilbert hears of the petition and as Stoney goes to register the claim, Gilbert’s men kill Dave and his daughter Julie Jane.  Gilbert then tries to place the blame on Stoney, arresting him and claiming that Stoney killed Dave to get full shares of the mine.  Some of the townspeople buy into Gilbert’s story, but those close to Dave and Stoney don’t buy it, including Dave’s older surviving children, Nancy and Billy.  Nancy and Billy join with Tucson and Lullaby in getting Stoney out of jail before an angry mob burns it down.  The murders of Dave and little Julie Jane have weighed heavily on Judge Henry Hixon however, and he telegraphs the governor informing him that Gilbert and his men committed the crime.  It doesn’t take long for word to reach Gilbert that Hixon talked and Gilbert shoots Hixon in front of several witnesses, ending his reign of terror.
 
Notes:

The Three Mesquiteers series was a series of 8 films made by Republic studios through 1938 to 1939.

According to the American Movie Channel, this is the first Hollywood film where the villain murders a child.
