Tim Benton and Red Larkin escape from jail. Little does Tim know that he was going to be released from prison, having been pardoned. He is determined to make it to Silver City and steal a mine payroll that is really his and clear his name for the crime that landed him in prison. Red shoots a man who is following them and the man is the new Sheriff whom no one has met. Tim takes all of his belongings and clothes, not knowing the town will be waiting to meet him as the new Sheriff.
